At the South End of the rooftop pool deck of the Viridian there are two drop-offs of 225' with a landing speed of 65 mph and/or a drop-off of 350' with a landing speed of 100 mph AND NO FENCE OR GUARDRAILS. Is there any doubt this unfenced 14' section is a DEATH CHAMBER OF DEATH OR TRAP! Was this DEATH CHAMBER or DEATH TRAP (1) intentionally constructed by people who have an insidious, secretly held hatred of kids under 10 years of age, (2) designed as a kite surfing platform and abandoned by the builder due to lack of funding or permitting, (3) left in the present form without guardrails or fencing due to bribes being paid to a somewhat corrupt department of Metro Building codes and Pools, and (4) maintained in this HAZARDOUS form since 2006 by Viridian Board members intimidated by Metro Codes and misled by attorneys who are co-conspirators with a corrupt department of Metro Codes and Pools? Clearly, Metro follows these International Codes: According to the International Building Code 2000; Code 1003.2.12 Guards: "Guards shall be located along open-sided walking surfaces, mezzanines, industrial equipment platforms, stairways, ramps and landings which are located more than 30 inches above the floor or grade below." And Code 1003.2.12.1 Height: "Guards shall form a protective barrier not less than 42 inches high, measured vertically above the leading edge of the tread, adjacent walking surface or adjacent seatboard."

Also note that the attorney said this is a permanent nuisance (see pages 6,7) with the Viridian being responsible for a one-time tragic event. Wonder who pays for the 2nd, 3rd, 4th, 5th, etc. time kids plunge to their deaths while playing on these five open-sided walking surfaces? If you can find ANY evidence of coverage for catastrophic personal injuries in common areas, such as kids plunging to their deaths at the south end of the rooftop pool deck, how would you rate the coverage? See recent insurance certificates in the next section below. Any Viridian Owner may request, and receive, copies of these insurance certificates by contacting the management via email, etc.! Better yet, can anyone understand why the Viridian Boards are NOT willing to construct inexpensive guardrails to protect lives and property values. Tens of thousands of the estimated 12 - 15 million yearly visitors to the Smokies cross these footlogs. Notice that each footlog has some type of hand rail. Now, compare the 12" wide footlogs with the 13+" wide open-sided walking surfaces with NO fence at the south end of the rooftop pool deck at the Viridian!
